Tuesday, January 22nd, 2008A California Train Accident Attorney Looks at Choosing Attorneys in the Aftermath of the Metrolink Chatsworth Train Accident, and Recent Legislation
Monday, January 21st, 2008Train Accident Attorneys, personal injury lawyers and accident law firms in California can be found in every corner of the state. They can be found in cities in San Diego, CA such as Carlsbad, Oceanside, and Escondido, in Orange County, in cities such as Newport Beach, Huntington Beach, Anaheim, Santa Ana and Yorba Linda, in the Inland Empire cities of Rancho Cucamonga, Ontario, Riverside and San Bernardino and in Palm Springs and Palm Desert as well as in Ventura, Oxnard, and Simi Valley.
If you search for train accident attorneys today on the internet or on new sites, you will see how personal injury attorneys have either added train accident pages to their websites, or added information about the Chatsworth Metrolink train crash to existing pages.Attorneys who take such action are quick to recognize that taking such prompt actions can result in their being retained by victims of the train crash and their articles often provide useful information.
Often, however, victims of such a crash are wise to take a breath and wait before immediately retaining any such attorney, or even this law firm. Why? Because the investigation of the accident will be performed best not by such attorneys but by the NTSB, the National Transportation Safety Board.
Once that report is made public, you can bet that the entity for the party or parties at fault will seek to settle all of the cases in much the same way, whether the injured victims have an attorney or not.
The trouble with waiting for such reports however, is that you only have six months to file a claim against a public entity in California. The investigation report may take longer that to prepare.
Keep in mind an attorney can help ensure that an injured victim receives a fair settlement for his or her injuries or for the loss of a loved one, is in being organized in preparing what attorneys call a “demand package” that contains all of the medical bills and records and an analysis of the injured person’s claim.
If a family has lost a loved one, a demand package is still put together by the attorney representing the family members, only the demand package will also provide an analysis of the loss of economic benefits i.e. the earnings of the loved one and what that loss means to the family members such as the wife and children of the loved one.
An attorney can also prevent you from making serious mistakes such as allowing a recorded statement taken by an experienced risk management adjuster.
If an injured person or the family of a loved one is unable to put together such a demand package on their own, and it is not a simple task, then it is usually wise for the injured party or the family members to retain an attorney to represent them.
What injury victims and family members should not do, however, is rush to hire the first attorney who’s website pops up when searching for information on a disaster such as the Chatsworth Metrolink train crash. Take your time, meet with a sampling of attorneys who handle such cases, and then hire the attorney you are most comfortable with and with whom you have the most confidence. While expensive offices can mean a measure of success on the part of the law firm, an attorney with the drive and energy to focus on your case can be worth more than a law firm full of attorneys in comfortable surroundings.
You needn’t be concerned that your case may be affected by new legislation now being considered to require positive train controls into effect that would automatically stop trains which are on a collision course.
The fact that such a system was not in place at the time of the accident and the fact that, as announced by Metrolink, that their engineer failed to see one or more red lights, will all undoubtedly be considered by and utilized in determining fault for this tragic train crash. If as has been reported that one of the train engineers was texting on a cell phone at or shortly before the time of the accident, this will also be a major piece of evidence in determining fault on the respective parties and in determining what entities pay what percentage of the settlement amounts.
Keep in mind that it is also a good idea to have an attorney that is not representing other claimants in the accident. This is to ensure that there is no conflict of interest and that your interests and not those of an attorney’s other clients, are the attorney’s first and foremost concern.
News notes - On October 2, 2008, Federal Regulators issued an emergency order banning the use of all cell phones and other electronic devices by rail workers in view of the determination that the commuter train engineer in the Metrolink accident was texting only seconds before the crash in September 2008 that took the lives of 25 people.
On October 16, 2008 President Bush signed the Railroad Safety Improvement Act of 2008 requiring Positive Train Control automated braking systems for Class 1 railroads and passenger railroads by the end of 2015.

SANTA ANA
THE GROUP ANIMAL LOGIC WITH THE SONG WINDS OF SANTA ANA AND PHOTOS FROM THE INTERNET .Animal Logic was formed in late 1987 BY Stewart Copeland and Stanley Clarke. After auditioning hundreds of potential singer/songwriters without success, a two-song demo tape forwarded by a music publisher to Copeland of a then-unknown Deborah Holland, and her subsequent hiring, created Animal Logic. The band was orginally known as “Rush Hour” and included Police guitarist Andy Summers. Shortly after hiring Holland, who wrote nearly all the songs for the band . Summers left. Miles Copeland, also the manager for The Police eventually choose Animal Logic as the band’s permanent name. The first Animal Logic album was on I.R.S./Virgin Records in 1989, the second in 1991. The band split shortly after the second CD was released, as the hoped-for major commercial success did not occur, and Clarke returned to more lucrative studio and film recording. Copeland’s former bandmate Sting was at one point advertised as joining Animal Logic for a portion of their last U.S. tour, but the collaboration never in fact occurred. Animal Logic’s unique sound was provided by Holland’s lyrical and songwriting ability, combined with the all-star rhythm section of Copeland and Clarke. The music produced by the band can be considered as some of the most intelligent and sophisticated pop-rock offered in the past twenty years. Rancho Santa Margarita Bicycle Accident Lawyer’s Top Ten Things You’d Rather Have Done Than Ride Into a Bicycle Accident
Saturday, January 19th, 20081. Anything not so painful.
2. Stick your head in the sand.
3. Go ice fishing in your shorts.
4. Read Shakespeare and take a test afterwards.
5. Take the bar exam.
6. Clean bathrooms.
7. Go through boot camp.
8. Listen to bad music.
9. Watch your least favorite TV shows of all time.
10. Family reunions with dysfunctional relatives.
Now here are ten useful tips of advice from a bicycle accident lawyer to follow if you have been in an accident. You can also learn more about how to handle a bicycle accident in Rancho Santa Margarita, or any city, by calling the Law Offices of R. Sebastian Gibson at any of the numbers which can be found on our website at http://www.SebastianGibsonLaw.com and learning how we can assist you.
Obviously, if you have had an accident, and you are reading all of this advice, it’s probably been at least a few days since the accident. However, if it’s only been a few hours or if you ever have another accident, here’s what you should do the next time from the start.
First, take a look around and determine if you or anyone, are hurt. If so, taking steps like trying to prevent further injury or loss of blood are the most important thing you can do. Even if some other driver caused you to be injured, it’s just good manners to help the other driver if they are hurt. They may even be so thankful that they admit their fault to you. The worst thing you can do is get angry or start a fight.
Second, make sure everyone is safe from being injured further. If you are in the middle of traffic, and you are dizzy, sit down away from traffic. If your vehicle is a traffic hazard and you have accident warning devices like flares or triangles, put them out on the road to warn other drivers and get away from the car. Let the police an other emergency personnel investigate the scene with the vehicles in place and move them more safely at a later point.
Third, call the police. Accident reports are extremely helpful if the police will do such a report. Let the police know you are injured immediately. Answer the police questions honestly. But if you are dazed or confused, let them know you need medical treatment and answer only what you feel sure about. Remember, your statements can and will be used against you if you admit fault, and it will be too late and too fishy to later say you didn’t know what you were saying at the scene. Police know that your best recollection is immediately after an accident.
Fourth, get the other driver’s information including their names, addresses, driver’s license numbers, make and model of their vehicles, license plate numbers, and their insurance company name and policy number. If there are witnesses, get their names, addresses and telephone numbers as well. If the other driver makes any admissions of fault, write those down as well.
Fifth, if you have a camera on your cell phone or in the car and you aren’t too injured, take some photos of the vehicles and the scene. If you can’t do it right away, do it after you are released from the hospital.
Sixth, if you are hurt, obtain medical treatment. Don’t decline the ambulance or hospital examination to save your insurance company money or to be stoic. Take your valuables out of your car if you can and get checked out at the hospital. If you are not hurt, don’t get treatment you don’t need. However, remember, after an accident, you may feel a rush of adrenaline that causes you to only start feeling symptoms of pain a few hours later. If you have a health plan that requires you to obtain permission first, call them and find out where you are allowed to seek treatment.
Seventh, call a good bicycle accident lawyer as soon as you have had your initial treatment, so the attorney can gather other important evidence and prevent the insurance company from taking advantage of you and obtaining such things as recorded statements that you feel fine, when many of your symptoms have yet to manifest themselves. A good bicycle accident lawyer can save you from making a great deal of mistakes and can shoulder much of the hassle of knowing what to do about car repairs, car rentals, medical treatment, witness statements and the like. If you think you will save money by not having an attorney, think again. A good bicycle accident lawyer can almost always obtain much higher settlements, obtain reductions of medical bills and insurance liens and prevent you from making costly mistakes. Also, most bicycle accident attorneys advance costs of obtaining police reports, medical records and the like and are paid and reimbursed for these costs only out of any settlement.
Eight, you will need to report the accident to your insurance company, but since they will want to take a recorded statement from you, just like any other driver’s insurance company, it’s good advice to retain an attorney first. And if the other driver did not have insurance, remember that it is your own insurance company that will be your adversary. You will also need to report the accident to the Department of Motor Vehicles and your lawyer can give you the form for this.
Ninth, do not agree to settle your claim privately with the person at fault for the accident. This almost never works out to your advantage. Don’t agree not to call the police. Police reports that determine the fault for an accident are golden. Your agreement to not involve the police only affords an opportunity for the other driver to change his story and blame you when the police will no longer investigate the accident.
Tenth, don’t pay a traffic ticket without a fight if you weren’t at fault or agree to accept a small payment for your vehicle repairs without knowing that the amount will in fact cover the cost of all the repairs.
If you’ve had a bicycle accident in Rancho Santa Margarita, El Toro, Mission Viejo, San Juan Capistrano, Laguna Beach, Costa Mesa, Orange County, Yorba Linda, Tustin, Lake Forest, Fountain Valley, Newport Beach, Anaheim, Irvine, Huntington Beach, Corona del Mar, Santa Ana, Orange, Fullerton, or anywhere in Southern California, we have the knowledge and resources to be your Rancho Santa Margarita Bicycle Accident Lawyer and your Orange County Bicycle Accident Attorney.
