Santa Ana Condo Developments

Sunday, November 30th, 2008
Santa Ana
Paul Escobedo asked:

Santa Ana is the most populous city in Orange County California. This is a growing city, which is seeing a lot of new real estate developments. Of the many types of home properties coming up for sale, condominium units are on the rise and they are seen to be very popular with people. This is because condominium units give homeowners the benefit of owning property, but without any of the property maintenance as seen in a family home.

Santa Ana Condo Builders offer the latest in condominium design. Homes offer the best in facilities and conveniences and are worth a buyer’s investment efforts. Builders list out the features of their condominium constructions in complete detail so that interested buyers can read what is available in a particular property and make an informed decision. They will also offers options and upgrades for interested buyers.

Buyers are sometimes too confused on what to do about home upgrades and they send their upgrade specifications at the last moment, making things very difficult. Here are some tips to consider with respect to condo upgrade options:

• Look into each upgrade offered and choose only ones that you really require. You can surely find condo units at the lowest prices and be really surprised to find them just bare. This is because your costs are based on the upgrades you take up. So either look for builders offering certain features as built-in to the price and not as upgrades or be rather choosy with your upgrade so the cost is not to high for you.

• Sometimes you can do some of the upgrades yourself. So look into what these might be as you can save money here.

• Find out if the builder has a time period waiting which you have to specify upgrade options. Now if you ignore this point, you may find yourself in a disappointing situation, as other residents would have done everything necessary, while you would be left with no options but to do your upgrades after you move in.

• In case you are taking up a home mortgage, find out if your lender will finance your upgrade options completely. Some lenders may not do this and you may have to pay cash, so be sure to research this.

Buying a condominium unit in Santa Ana is an attractive investment option, be it for the purpose of primary residence or for the purpose of renting. Be sure to buy your property from a reputable condominium builder so that you can be certain that your home purchase is worth the money you are paying.

Santa Ana Auto Accident Attorney’s Top Ten Reasons not to Have an Auto Accident

Friday, November 28th, 2008
Santa Ana
R. Sebastian Gibson asked:

1) Children get annoyed.

2) Your dog may bite you.

3) Coffee stains are hard to get out.

4) Beer smell is a dead give away to the cops.

5) Handcuffs are not a good accessory.

6) Mug shots never turn out well.

7) You’ll miss your favorite TV shows.

8) Your employer will not be amused.

9) Your parents will figure it was your fault.

10) Your spouse will know it was your fault.

Here are ten actual tips of advice from an auto accident attorney to follow if you have been in an accident. You can also learn more about how to handle a personal injury in Santa Ana, or any city, by calling the Law Offices of R. Sebastian Gibson at any of the numbers which can be found on our website at http://www.SebastianGibsonLaw.com  and learning how we can assist you.

Obviously, if you have had an accident, and you are reading all of this advice, it may have been a few hours since the accident. However, if you ever have another accident, or if it’s only been a few hours since you were hurt, here’s what you should do from the start.

First, take a look around and determine if you or anyone, are hurt. If so, taking steps like trying to prevent further injury or loss of blood are the most important thing you can do. Even if some other driver caused you to be injured, it’s just good manners to help the other driver if they are hurt. They may even be so thankful that they admit their fault to you. The worst thing you can do is get angry or start a fight.

Second, make sure everyone is safe from being injured further. If you are in the middle of traffic, and you are dizzy, sit down away from traffic. If your vehicle is a traffic hazard and you have accident warning devices like flares or triangles, put them out on the road to warn other drivers and get away from the car. Let the police an other emergency personnel investigate the scene with the vehicles in place and move them more safely at a later point.

Third, call the police. Accident reports are extremely helpful if the police will do such a report. Let the police know you are injured immediately. Answer the police questions honestly. But if you are dazed or confused, let them know you need medical treatment and answer only what you feel sure about. Remember, your statements can and will be used against you if you admit fault, and it will be too late and too fishy to later say you didn’t know what you were saying at the scene. Police know that your best recollection is immediately after an accident.

Fourth, get the other driver’s information including their names, addresses, driver’s license numbers, make and model of their vehicles, license plate numbers, and their insurance company name and policy number. If there are witnesses, get their names, addresses and telephone numbers as well. If the other driver makes any admissions of fault, write those down as well.

Fifth, if you have a camera on your cell phone or in the car and you aren’t too injured, take some photos of the vehicles and the scene. If you can’t do it right away, do it after you are released from the hospital.

Sixth, if you are hurt, obtain medical treatment. Don’t decline the ambulance or hospital examination to save your insurance company money or to be stoic. Take your valuables out of your car if you can and get checked out at the hospital. If you are not hurt, don’t get treatment you don’t need. However, remember, after an accident, you may feel a rush of adrenaline that causes you to only start feeling symptoms of pain a few hours later. If you have a health plan that requires you to obtain permission first, call them and find out where you are allowed to seek treatment.

Seventh, call a good auto accident lawyer as soon as you have had your initial treatment, so the attorney can gather other important evidence and prevent the insurance company from taking advantage of you and obtaining such things as recorded statements that you feel fine, when many of your symptoms have yet to manifest themselves. A good auto accident lawyer can save you from making a great deal of mistakes and can shoulder much of the hassle of knowing what to do about car repairs, car rentals, medical treatment, witness statements and the like. If you think you will save money by not having an attorney, think again. A good auto accident lawyer can almost always obtain much higher settlements, obtain reductions of medical bills and insurance liens and prevent you from making costly mistakes. Also, most auto accident attorneys advance costs of obtaining police reports, medical records and the like and are paid and reimbursed for these costs only out of any settlement.

Eight, you will need to report the accident to your insurance company, but since they will want to take a recorded statement from you, just like any other driver’s insurance company, it’s good advice to retain an attorney first. And if the other driver did not have insurance, remember that it is your own insurance company that will be your adversary. You will also need to report the accident to the Department of Motor Vehicles and your lawyer can give you the form for this.

Ninth, do not agree to settle your claim privately with the person at fault for the accident. This almost never works out to your advantage. Don’t agree not to call the police. Police reports that determine the fault for an accident are golden. Your agreement to not involve the police only affords an opportunity for the other driver to change his story and blame you when the police will no longer investigate the accident.

Tenth, don’t pay a traffic ticket without a fight if you weren’t at fault or agree to accept a small payment for your vehicle repairs without knowing that the amount will in fact cover the cost of all the repairs.

Joint Ventures and Political Running Mates - It’s the Economy, Stupid, That Usually Makes Them Work or not

Friday, November 28th, 2008
Santa Ana
R. Sebastian Gibson asked:

Joint Ventures can be formed for various reasons, but first and foremost is usually to share the risks of the business venture and to save money. Whether the entities are formed in Palm Springs, Palm Desert, Indian Wells and La Quinta or in San Diego, California, La Jolla, Del Mar, Carlsbad, or San Marcos, in Orange County, CA cities such as Anaheim, Irvine, Newport Beach or Santa Ana, in the Inland Empire, or the Central Coast, the reasons for hiring a joint venture attorney to facilitate the joint venture are usually the same. If there is synergy between the two entities forming the joint venture, they can build on each other’s strengths. The same is often true in politics. But the economy trumps everything, both in business and politics.

Today’s most exciting and most talked about joint ventures are not between corporations. With the credit crisis, corporations are unable to obtain the credit to finance new ventures, and are looking to other companies for the resources they may have. Unfortunately, many corporations in this economic crisis are simply hunkering down and holding onto what cash they have.

No, today’s most exciting joint ventures are in politics. That’s right the joint venture between John McCain and Sarah Palin and the joint venture between Barack Obama and Joe Biden.

What has this got to do with the law, you ask? Plenty. First, of course the winning joint venture may decide the direction of America for the next four to eight years. But second, they are a good picture window into how joint ventures can work, or fail.

In the case of John McCain and Sarah Palin, you had the initial excitement when the joint venture was formed and there was a great deal of buzz about the combination. There was good synergy, and Sarah Palin seemed to offer what John McCain lacked, namely youth. Additionally, Ms. Palin was able to rally the staunch conservatives who previously had been less than enthusiastic about the Republican party’s nominee.

However, with time, the enthusiasm for this joint venture has faded as so often happens with joint ventures. As Ms. Palin was vetted, she was found to have some baggage including something called Troopergate, in which pressure was allegedly brought to bear on a government employee to fire the ex-husband (a state trooper) of her sister. While a state legislature report found she did not violate any laws but may have acted unethically, this baggage did not pose any serious worries for the other half of the joint venture, John McCain.

It wasn’t until weeks after sheltering Ms. Palin from the press, that she was allowed to finally give some interviews. These did not go well. Like an athlete who has lost their confidence, Ms. Palin stuttered and gave answers that made beauty contestants seem like geniuses. Her attempt to obtain some foreign policy experience by holding a succession of short meetings with world leaders at the U.N. seemed more like speed dating when those world leaders complimented her not on her foreign policy expertise but on her looks, with one world leader trying to get the press photographers to ask them to hug.

On the other hand, as is true with many joint ventures, Ms. Palin did, however, generate substantial energy among conservatives who, until her choice as a Vice Presidential running mate, had seemed lukewarm toward the Republican ticket.

In the joint venture between Barack Obama and Joe Biden, there was perhaps less enthusiasm than the Republican joint venture but a similar synergy of adding a vice presidential pick with the qualities Obama was thought to be lacking - in this case, Joe Biden’s foreign policy experience.

Also similar to the Republican joint venture’s failings, Joe Biden proved to make a number of embarrassing gaffes on the campaign trail. None were as severe as Sarah Palin’s interview answers but neither did he seem to be adding the enthusiasm that Sarah Palin had at least rallied on the announcement of her name.

If, as polls currently suggest, the economy is going to decide this election, financial forces, as with most joint ventures, will determine which joint venture is successful and which will not. As the economy worsens, as bailout plans are passed and then criticized, the Obama-Biden joint venture is succeeding for being thought of as more knowledgeable and able to make change. The McCain-Palin joint venture on the other hand seems to be slipping downward day by day as McCain’s efforts to help with the bailout plan appear misguided, and as both he and Ms. Palin become the stuff of late-night comedian monologues.

Joint ventures can be tricky and in the end, it’s usually the economic conditions that either spell their success or failure.

California Helicopter Aviation Lawyer Discusses the Rash of Ems Helicopter Crashes in the U.s

Thursday, November 27th, 2008
Santa Ana
R. Sebastian Gibson asked:

An unexpected catastrophe is happening on the way from horrific accident scenes in California on the way to hospitals in EMS helicopters. The helicopters are crashing killing many of the occupants at an unacceptable rate. If you’ve been injured in Southern California, whether it is in Laguna Beach, Anaheim, Santa Ana, Costa Mesa, Irvine, Orange, or Yorba Linda, in Orange County, or Carlsbad, Oceanside, La Jolla, Del Mar, San Marcos, Vista and Escondido in San Diego, CA or in Palm Springs, Palm Desert, Indio, Coachella, Yucca Valley or some remote area and it is dark, or in bad weather, your chances of surviving the trip to the hospital may be better in an ambulance.

Deaths as the result of helicopter crashes in the U.S. have been soaring to record levels and the National Transportation Safety Board has been investigating just what is behind this rash of Emergency Medical Service and Police helicopter crashes.

In the past 12 months, 31 people have died in eight crashes. EMS helicopter crashes in the U.S. have become one of the most dangerous areas of aviation and one of the highest accident rates for aviation crashes. This year alone, 24 people have died on medical airlifts.

An NTSB study of EMS helicopter crashes between 1983 and 2005 found that the majority of the crashes occurred - 77 percent as opposed to 31 percent - when weather conditions forced pilots to fly using their instruments rather than by looking outside for visual cues. In darkness, 56 percent of the crashes were fatal as compared to 24 percent when the flight was not in darkness.

That study determined 29 of those 55 accidents could have been avoided. A number of safety issues were identified. Consequently, in 2006, the NTSB issued a special report to address the safety issues of these flights to accident scenes and sought computerized safety equipment, terrain awareness and warning systems (TAWS) (also referred to as terrain avoidance technology) to warn pilots when they were flying too close to land.

It has been reported that while some progress has been made, none of the NTSB recommendations from that report have been fully implemented.

All but two of the past eight fatal EMS accidents have been at night or in bad weather.

By comparison, the fatal crash rate for ambulances is nothing like it is for helicopters.

Now the U.S. House and the Senate are considering legislation to address these safety issues and place higher standards on the industry.

Until this situation is improved, pilots of EMS helicopters as well as the police and medical personnel on the ground have to take into consideration the condition of the injured persons at accident scenes, the dangerousness of the location, as well as the weather conditions and darkness in determining if the accident victims can be taken to a hospital by ambulance or if the risks warrant the use of an EMS helicopter, both for the safety of the injury victims and the EMS pilots, flight nurses and paramedics.

Veteran EMS pilots say the use of night-vision goggles could improve their safety. But because of the wars in Iraq and Afghanistan, there is apparently a shortage of these goggles. Fewer than a third of the 800 EMS helicopters in the U.S. have night-vision technology. The wait time for civilian use of the goggles at the largest U.S. manufacturer is six to eight months.

California’s Water Bank and the Drought in California - a California Water Law Attorney Conclusion - We’re Dry Out Here

Wednesday, November 26th, 2008
Santa Ana
R. Sebastian Gibson asked:

Here in the desert cities of Palm Springs, CA, Joshua Tree, Palm Desert, Cathedral City, Indian Wells, Yucca Valley, Rancho Mirage, Desert Hot Springs, Twentynine Palms, Thermal, Indio, Coachella, La Quinta, Victorville, Hesperia, Apple Valley or Barstow, in the somewhat greener areas of Southern California such as Newport Beach, Buena Park, Anaheim, Irvine, Rancho Cucamonga, Ontario, Carlsbad, Mission Viejo and in other cities in San Diego,Orange County, Santa Barbara, San Luis Obispo, Cambria, agricultural areas such as the central valley of Fresno and the Imperial Valley, the drought in California is a serious problem for all of us in this State.

After the driest spring in 88 years, in June 2008 Governor Schwarzenegger formally declared California to be in a drought and nine counties in the Central Valley to be in a state of emergency after two years of below-average rainfall and six dry years that have killed off fish populations, driven down agricultural land values and required severe reductions in water usage in the Central Valley. The declaration, while bad enough, still stops short of a statewide water emergency which, if declared, will likely carry with it mandatory water rationing.

Efforts to capture water have been hampered by evaporation of snow packs due to climate change, but snowpack water content this winter was only 67 percent of average. California’s water shortage was compounded by a federal court order limiting the pumping of water from the San Joaquin-Sacramento River Delta to protect a species of fish.

And so in June 2008 the State of California formed a Water Bank to buy water from farmers upstream from the Delta and from local water agencies and to make it available for sale to public water systems and private water systems who may otherwise run short of water next year. Agencies buying the water will have to agree to a 20 percent reduction overall in water usage. It is believed that the Water Bank will stave off mandatory water rationing.

Under the plan, water purchased from northern farmers and water agencies will be shipped south via the State’s canals.

Currently, there is no end in sight to California’s dry conditions. While there is a $9.3 billion plan in the State legislature to address the state’s delta environmental problems and expand the state’s water works, it has been tied up while the legislators haggled over a budget.

A bill to require Californian’s to cut water usage by 20 percent recently passed the Assembly and the bill puts the onus on residents as opposed to farmers.

In the midst of this water crisis, an amazing 100 facilities are bottling water in California, using California’s precious water supply. An Assembly Bill to measure the amount of water being bottled is an attempt to learn just how bad the abuse of these water supplies is on top of the pollution and harm to the environment caused by these facilities and the plastic water bottles, most of which are not recycled.

The Department of Public Resources estimates that more than 1 billion gallons of bottled water are sold in California each year.

If you have a water law issue in San Diego, Newport Beach, Irvine, Orange County, La Jolla, in the Inland Empire, Los Angeles, Palm Springs or anywhere in Southern California, we have the knowledge and resources to be your California Water Lawyer and your Santa Barbara Environmental Attorney.
